I, the registering participant (the “participant”), hereby acknowledge that I am voluntarily participating in the residential camp experience set forth herein below (the “event”) and that I am aware and fully understand and acknowledge that there are certain known risks and unknown or unanticipated risks, dangers and hazards that are inherent in the activities in which I am about to engage voluntarily as a participant. I understand that participation in the event involves potential risk of injury, death, pain, suffering, physical or mental illness, anguish or disease, emotional distress, or damage to me, my property or to third parties. Such risks include, without limitation, uneven terrain, standing and moving water, forested and other areas that may result in wildlife encounters including mammals, reptiles and insects that could result in infections and various insect-transmitted diseases. I know that I should not participate in the event in any manner unless I am medically and physically able.

Knowing and appreciating such risks, I, for myself and my respective heirs and assigns, hereby voluntarily consent to and assume all such risks and hereby voluntarily release, forever discharge and agree to hold harmless and indemnify Trybal Gatherings Inc. (“Trybal Gatherings”), its affiliates, and their respective officers, directors, employees, agents and representatives (collectively, the “releasees”), from any and all liabilities, claims, demands, actions or rights of action which are related to, arise out of, or are in any way connected with my participation in the event, including specifically but not limited to any and all claims arising out of or relating to the negligent acts or omissions of any person or entity, for any and all injury, death, illness or disease, and damage to me or to my property or damage to others or others’ property.

In particular, I assume all risks associated with travel, transportation, accommodations and all other support services provided in connection with my participation, all such risks being known and appreciated by me. I assume the complete and sole responsibility for determining and assessing any and all risks that may be involved in my participation in the event notwithstanding any information, guidance or assistance that the releasees in good faith may or may not have given me. In signing this release, I fully recognize that if anyone is hurt or property is damaged while I am engaged in the event, I will have no right to make a claim or file a lawsuit against any of the releasees. I hereby agree that I will not sue any of the releasees for any damage, injury or loss on my own behalf, whether caused by negligence or not, in any way related to the event. Should it become necessary for any of the releasees to incur attorneys’ fees and costs to enforce this agreement or any portion thereof, I agree to pay the reasonable costs and attorneys’ fees thereby expended, or for which liability is incurred. By voluntarily participating in the event, I acknowledge that I have equal bargaining power with the releasees with respect to this release.

I certify that either (a) I have sufficient health, accident and liability insurance to cover any bodily injury or property damage I may incur and to cover bodily injury or property damage caused to a third party as a result of my participation in the event or (b) if I have no such insurance, I certify I am capable of personally paying for any and all such expenses and liability.

I give permission for the free and unrestricted use, without recourse, compensation or approval, of my name and photographs/film/videotapes/electronic representations and/or sound recordings of me as a participant in the event for all purposes, including, without limitation, promotions, publicity, souvenirs, posters, brochures and other materials.

I hereby certify that the information in my registration is true and correct to the best of my knowledge. I agree to abide by all policies, including the terms and conditions of enrollment, associated with the event. I acknowledge that I am familiar with these policies and will obey them. I understand I will be held financially responsible for any damage to camp property that I cause. I agree to be responsible for all fees associated with the event and acknowledge that all ticket purchases are final and no refunds will be provided after Tuesday, July 30, 2024, which is 30 days prior to the start date of the program.

TRYBAL GATHERINGS PROGRAM CONDUCT
Respect Camp Rules: We are grateful to the local camp community for allowing us to call their campus our home for the weekend. Please obey their local policies and be kind to staff.
No illegal drugs of any kind: Camp and campers are subject to all local and federal laws. If you are caught using illegal drugs, you will be removed from camp immediately at your own expense.
No weapons of any kind: Weapons including, but not limited to, knives, guns, fireworks, smoke bombs, explosives or any flammable/hazardous materials are prohibited in camp,
prohibited from being carried, and prohibited on camp property at all times. We reserve the right to ask anyone to leave immediately who is caught violating or suspected of violating this policy.
Closed Campus: Camp gates will be closed once the weekend officially begins and will remain closed until departure on Sunday. Campers will not be permitted to leave camp during the weekend (unless an emergency arises).
No excessive alcohol consumption
Always treat your fellow travelers and staff with respect and dignity
No damaging of any local of personal property, facilities, or equipment
Follow instructions provided by Program staff
Respect the intent to create a pluralistic Jewish space in this Program

I understand that Program staff are not responsible for preventing or otherwise policing violations of the above conduct violations, and that the Organizer is not responsible for any injury or damage resulting from a violation of these conduct policies. At any time, Trybal Gatherings may find it necessary to alter and/or add rules and restrictions. As a camper, I agree to fully comply with all rules or restrictions, including any alterations and/or additions made by Trybal Gatherings. All rules and restrictions apply throughout the entirety of Camp. Any failure to comply with Camp rules and restrictions and any alterations and/or additions there to may result in disciplinary measures, at the sole discretion of Trybal Gatherings, up to and including immediate dismissal and/or other removal from Camp. The listed rules and restrictions are not exclusive and the failure to specify in each rule that violation may result in discipline, dismissal and/or other removal from Camp shall not preclude Trybal Gatherings from doing so in its sole discretion. Further, the failure of Trybal Gatherings at any time to enforce any rule or restriction or to exercise any right with respect to disciplinary action, will not be construed as a waiver of any such right, will not affect any subsequent violation, and will not prejudice Trybal Gatherings in connection with any subsequent enforcement or disciplinary action.

While we wish that we could control every possible risk, and while we will use our best efforts to keep you safe from the COVID 19 virus, we want to make clear that we cannot promise or guarantee that this or any other pathogen will not enter camp, and that by the very nature of the personal interaction that takes place in the camp environment, there is always a risk of becoming ill with this or any other communicable disease. We want you to be fully aware of this risk in making the decision to attend camp this summer, and that you are willing to assume and accept it.

This release constitutes the sole and entire agreement of Trybal Gatherings and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this release or invalidate or render unenforceable such term or provision in any other jurisdiction. This release is binding on and shall inure to the benefit of Trybal Gatherings and me and their respective successors and assigns. All matters arising out of or relating to this release shall be governed by and construed in accordance with the internal laws of the Commonwealth of Massachusetts without giving effect to any choice or conflict of law provision or rule.

BY REGISTERING FOR THIS PROGRAM, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE TRYBAL GATHERINGS.

My registration indicates that I have read this entire release, understand it completely, understand that it affects my legal rights, and agree to be bound by its terms.
